How This trust Works:
If a foreigner, as provided for in the said
May, 16, 1989 Decree, Issued by the
president of Mexico at the time Carlos
Salinas, wishes the right to use a certain
piece of land, He can instruct a Mexican
Fiduciary Institution (A Bank), as trustee,
to purchase and hold the property for up to
50 years, the trustee will become the new
legal owner subjected to the clauses of the
trust contract, which guarantees the
beneficiary his full right as described
hereafter.
Rights of the beneficiaries:
The beneficiary will have the right to use
and enjoy the property, that is, he may live
on the land, undertake any construction
necessary, and instruct the trustee to
transfer the property to any person who has
the legal capacity to acquire the same.
Furthermore, the Beneficiary has the right
to assign his beneficial rights, with the
sole obligation of giving notice to the
trustee of such assignment. In other words,
the trust contract (Fideicomiso) Guarantees
the Beneficiary the property, without
restrictions, as if he where a Mexican
